Overview
As of February 3, 2025, President Trump has issued 12 Executive Orders associated with immigration. They are:
Declaring A National Emergency At The Southern Border Of The United States
Clarifying the Military’s Role in Protecting the Territorial Integrity of the United States
Expanding Migrant Operations Center at Naval Station Guantanamo Bay to Full Capacity
Imposing Duties to Address the Situation at our Southern Border
Currently, there are at least 11 challenges to these EOs according to Litigation Tracker: Legal Challenges to Trump Administration Actions. Of particular interest to our community are the following:
New Hampshire Indonesian Community Support v. Donald J. Trump - Challenges Trump’s right to revoke birthright citizenship. (One of multiple lawsuits on this issue.) As of February 3, 2025, there is a temporary restraining order against this EO.
Make the Road New York v. Benjamine Huffman (Acting Secretary of Homeland Security) et al - Challenges the right of the Department of Homeland Security to expand the use of expedited removal under the Immigration and Naturalization Act. The plaintiff argues this EO violates the Fifth Amendment Due Process clause, the Immigration and Nationality Act, and the Administrative Procedure Act.
